IG KOOME ORDERED TO PUBLICLY APOLOGIZE AND COMPENSATE KPMDU’S ATELLAH

Inspector General of Police Japhet Koome has been directed by the Milimani High Court to issue a public apology to Kenya Medical Practitioners and Dentists Union (KMPDU) Secretary-General Davji Atellah.

Judge Jairus Ngaah, in orders issued on Tuesday, mandated, “The Respondent be and is ordered to publish, in a newspaper of national circulation within 14 days of this order, an apology to Dr. Davji Atellah for the violation of his rights by the police.”

Atellah, who was hit by a teargas canister during a striking doctors‘ protest at Afya House, Nairobi, on February 29, spoke out against the injustice, highlighting the need for accountability and justice.

Additionally, IG Koome is required to compensate Atellah for rights violations during the protest.

“This compensation is in accordance with Article 23 of the Constitution and Section 7(1)(j) of the Fair Administrative Action Act,” stated Justice Ngaah.

The court also instructed IG Koome to submit an affidavit within 30 days detailing steps taken to comply with the court’s directives.

Furthermore, the court ordered investigations into and disciplinary action against police officers responsible for using unlawful force during the protest, emphasizing the importance of upholding rights and ensuring accountability.

“We will not tolerate the suppression of peaceful protests and demonstrations,” declared the Judge.
